Worker's Comp

While small businesses are concerned about the need to raise benefits for disabled employees, it must be balanced with fraud control and affordable premiums for small business employers CSBA seeks innovative solutions such as 24 Hour Care, Small Business purchasing pools, etc. The unrealistic increases in premiums for commercial and professional liability insurance and bonding have placed a major hardship on small business.

BILL SUMMARIES

 

AB 338 – Coto: Workers' compensation: temporary disability payments: Would delete an obsolete reporting requirement and would require the administrative director to present to the Governor an evaluation of the benefits to injured workers as a result of funds owed to those workers.

AB 550 – Ma: State Compensation Insurance Fund: health care service plans: Authorizes the State Compensation Insurance Fund to transact group health insurance the same way as any other insurer would

AB 797 – Insurance Committee: Insurance agents: Provides that the curriculum board of the Insurance Commissioner to approve standards for courses in business management practices which may consist of up to 25% of the agent or broker requirements for license renewal.  

AB 1212 – Nunez: Workers' compensation: permanent disability: Directs the Administrative Director (AD) of the Division of Workers' Compensation to revise the permanent disability rating schedule (PDRS) to increase ratings based on empirical studies of ratings and wage losses, including the studies produced by the Commission on Health and Safety and Workers' Compensation (CHSWC).

AB 1401 – Aghazarian: Insurance fraud: assessments: This bill would provide that the assessment be adequate to support the expenditures for general fraud operations annually in the Budget Act.

AB 1619 – Benoit: Insurer incensing: Allows any insurer admitted to transact health insurance or workers' compensation insurance to make a written application to the commissioner for a license to offer a single policy that provides both health care services and workers compensation benefits.

SB 357 – Cox: Life insurance: group policies: Provides that group life insurance may be written under a policy covering not less than 2 persons instead of 10 and other requirements.  

SB 365 – McClintock: Out-of-state carriers: Allows a carrier of health service in another state to offer a health care service plan or policy in this state without holding a license issued by the department or certificate of authority issued by the commissioner.

SB 711 – Runner: Insurance: rate fillers: Would provide that the adequacy or inadequacy of each insurers' rates shall be determined by its own experience and not by the experience of its affiliates.  

SB 723 – Yee: State Compensation Insurance Fund: health system improvement study: Would authorize the State Compensation Insurance Fund to transact group health insurance with employers insured by the fund for workers' compensation.  

SB 869 – Ridely-Thomas: Workers' compensation insurance: coverage program: Founds the Uninsured Employer Database from the Fraud Division within the Department of Insurance to identify employers not providing workers' compensation insurance.  

SB 936 – Perata: Workers' compensation: permanent disability schedule: Increases the number of weeks that permanent disability (PD) benefits are paid, thereby increasing the amount of money received for each percent of disability.

SB 942 – Migden: Workers' compensation: Misdemeanor offense for an employer to refuse to reinstate an employee injured on the job to his or her pre-injury position for discriminatory reasons. Allows a worker who sustains partial and permanent disability from an injury to a supplemental job displacement benefit and would revise the amount of benefits an injured employee would receive. Would not hold employer accountable for supplemental job displacement if the employee does not accept the offer before 10 days.
