Procurement

Small businesses need a level playing field when it comes to competing for state and local procurement. Smaller enterprises should be automatically informed about available government contracts. Here should be one set of small business criteria for all local, state, and national agencies for government contracts. These criteria must provide parity and compliance with the Governor’s Executive Order for all small businesses.

AB 396 – Hernandez: Public contracts: bid preferences: employee health care expenditures: Increases access to health care coverage for employees who work on public works projects by requiring public entities bidding out public works contracts to the lowest bidder to provide a 2.5% employee health care expenditure bid preference.

AB 1942 – Ruskin: Public contracts: small businesses and disabled veteran business enterprises: Makes a technical change to law regarding small business gaining access to state agency contracts.

AB 2360 – Levine: Public contracts: state contracts: healthy lifestyle benefits: Requires corporations seeking to do business with the State of California to provide their employees with benefits that promote a healthy lifestyle.

AB 2376 – Price: Small and Emerging Contractors Technical Assistance Program: Would provide training for small business contractors to improve their ability to secure surety bond guarantees which is necessary to qualify for public works construction projects. Would charge a fee to participants in the program.

AB 2603 – Eng: Public contracts: reports: Requires sate agencies to prepare an annual report regarding service and consulting contracts entered into by the agency.

AB 2773 – Price: Public contracts: Small Business Procurement and Contract Act: Changes the Small Business and Contract Act to instead establish a 2009 cost threshold at $250,000 which would be adjusted every 2 years.

AB 2778 – Mendoza: Small business and procurement: Changes the standards for manufacturers under the Small Business Procurement and Contract Act.

AB 2797 – De La Torre: State contracting: small business preference: Increases the bidding preferences afforded by DGS (Dept. of General Services) to small businesses from 5% to 10%.
AB 3020 – Salas: State Contract Act: This bill would expand the definition of "department" for purposes of contracting for a public work to include the Military Department.

SB 1596 – Yee: University of California: public contracts: Limits the term of a contract for services, goods or materials, to the winning bid, to 3 years with limitations on extending the contract for contracts with the University of California schools.

SB 1687 – McLeod: State contracts: participation goals: developmentally disabled business enterprises: Establishes a statewide participation goal of not less than 2% for developmentally disabled business enterprises to participate in all contracts awarded by the state for construction, services, materials, supplies, equipment, alterations, repairs or improvements.

SB 1698 – Romero: Contractors: Public works: Prohibits a contractor from performing work as a contractor or subcontractor on a public works unless he or she has obtained a public works certification from the board.
