BILL SUMMARIES

AB 1874 – Coto: State Compensation Insurance Fund: Makes changes to the board of directors which administers the State Compensation Insurance Fund.

AB 2081 – Coto: Workers' compensation: Prohibits an officer or director holding less than 10% of the shares of the corporation from excluding himself or herself from workers' compensation coverage required to be provided to other employees of the corporation. It also provides that if an officer or director holds more than 10% of the shares of the corporation, the employer shall have the burden of proof of demonstrating that an exclusion of that officer or director from workers' compensation coverage is appropriate.
AB 2181 – Ruskin: Workers' compensation: Return-To-Work Program: Extends the Return-To-Work Program until January 1, 2015.
AB 2351 – Garrick: Workers' compensation: medical treatment utilization reviews: This bill would require that, in cases where the review is retrospective, the decision to modify, delay, or deny services be communicated to the individual who received services, or to the individual's designee, within 30 working days of receipt of information that is reasonably necessary to make this determination.
AB 2969 – Lieber: Workers' compensation: medical treatment utilization reviews: Requires that any licensed physician who is conducting an evaluation regarding a workers' comp claim be licensed in California.

SB 1145 – Machado: Makes changes to the board of directors which administers the State Compensation Insurance Fund.

SB 1189 – Cedillo: Workers' compensation: supplemental job displacement benefits: Increases workers’ compensation costs by requiring employers to provide injured workers with supplemental job displacement vouchers before having all the information required to calculate the benefit.
SB 1338 – Migden: Workers' compensation: medical treatment: pre-designation of physician: Would allow employees receiving treatment regarding a workers' comp case to keep seeing their own personal physician.
SB 1717 – Perata: Workers' compensation: permanent partial disability benefits. To delete from law a provision designed to provide an incentive to get injured employees back to work with their employer, which incentive is seen to be ineffective. Also to increase the number of weeks of indemnity payments for the range of percentages of permanent partial disability ratings.
